Attorney Sami Azhari of Azhari LLC was recently published in the American Bar Association’s semi-annual White Collar Crime Newsletter. The article focused on recent proposed amendments from the United States Sentencing Commission for the Federal Sentencing Guidelines. Azhari teamed up with Professor Aliza Hochman Bloom of New England Law School.

The article discussed whether criminal defendants should be entitled to a downward departure for not taking a case to trial despite filing a motion to suppress on a constitutional issue. Currently, the guidelines do not address the split in the appellate courts and the proposed amendments from the Commission did not rectify the issue. Attorney Azhari also submitted his article to the Commission at the request of one of the attorneys sitting on the Commission.
