Power Morcellator Lawsuit Claims Device Spread Cancer In Florida Woman

Tracey & Fox reports on another lawsuit filed against a power morcellator device and manufacturer Karl Storz Endovision, Inc. This lawsuit was filed in the United States District Court for the Southern District of Florida under case number 14-cv-61086. The woman filing the case, a resident of Florida, alleges that the Karl Storz Endovision laparoscopic power morcellator used during her supracervical hysterectomy uncovered and spread previously undetected cancer cells.

Details of the complaint note that the plaintiff underwent her gynecological surgery on April 8th of 2013. Beforehand, the woman had pre-anesthetic testing, which showed no sign of cancer. Post-surgery, however, she was quickly informed that pathologists had discovered endometrial stromal sarcoma, which had been contained within one of the uterine fibroids she had removed.

The plaintiff alleges that as the power morcellator device was inserted into her abdomen and proceeded to shred her uterine fibroids, it exposed and then spread the previously encapsulated cancer cells. This caused her cancer to be quickly advanced, and significantly impaired her ability to treat it, as well as her overall life expectancy.

Just as this plaintiff asserts, many others across the U.S. also allege that laparoscopic power morcellation accelerates and spreads cancer. As allegations of this kind continued to appear, the United States Food and Drug administration also made an announcement regarding the device. Their safety warning stated that most women should refrain from using power morcellation devices during gynecological surgeries involving uterine fibroids, due to the risk of spreading previously undetected cancers. Additionally, they noted that an estimated 1 in every 350 women undergoing laparoscopic power morcellation procedures may have hidden uterine sarcomas.

The cases involved in the power morcellator litigation have been consolidated to form multidistrict litigation, and they currently await trial.
