Denver Clinic Explains Why Schedule III Hasn't Changed Red Cards

MMD Medical Doctors, a Denver medical marijuana evaluation clinic rated 4.2 stars across 172 Google reviews as of August 2026, is addressing a question patients have raised since spring: whether this year's federal rescheduling activity changes how a Colorado red card is issued. Based on the federal and state documents now on the record, it does not.

Two separate federal actions are frequently conflated, and the difference is what determines whether a patient's card matters. In an order signed by Acting Attorney General Todd Blanche and published in the Federal Register on April 28, 2026, under Attorney General Order No. 6753-2026, the U.S. Department of Justice placed two categories of marijuana in Schedule III of the Controlled Substances Act: marijuana contained in a drug product approved by the U.S. Food and Drug Administration and marijuana covered by a state medical marijuana license. By the order's own terms, marijuana that falls outside those two categories was not moved.

The broader question is unresolved. The Drug Enforcement Administration's proposal to reschedule marijuana as a whole, first published May 21, 2024, at 89 FR 44597, remains a proposed rule. DEA published a notice of hearing on that proposal on April 28, 2026, at 91 FR 22777, setting an evidentiary hearing to begin June 29 and conclude no later than July 15, and announced the opening in a June 25 press release. As of the date of this release, DEA has published no final rule on the broader proposal and no public recommendation from the administrative law judge presiding over that hearing. Current status is posted on DEA's marijuana rescheduling regulatory actions page.

Neither action changes Colorado's registry. The Colorado Medical Marijuana Registry, created under Article XVIII, Section 14 of the Colorado Constitution and administered by the Colorado Department of Public Health and Environment under Section 25-1.5-106, C.R.S., still issues the cards. Cards are valid only in Colorado. Physicians in the program certify that a patient has a qualifying condition; they do not write prescriptions, and no federal action this year created a pharmacy pathway for cannabis. Patients arriving at the clinic's Sherman Street office in Denver's Capitol Hill neighborhood, blocks from the State Capitol, have asked about both points.

State eligibility criteria are set by law rather than by any clinic. The Colorado Constitution lists eight debilitating medical conditions: cancer, glaucoma, HIV or AIDS, cachexia, persistent muscle spasms, seizures, severe nausea and severe pain. CDPHE guidance identifies disabling medical conditions as post-traumatic stress disorder, autism spectrum disorders and any condition for which a physician could prescribe an opioid, citing Section 25-1.5-106, C.R.S., and House Bill 19-1028. Conditions outside those categories do not qualify on their own, which is why a diagnosis alone does not settle eligibility and an evaluation does.

CDPHE also sets who may certify. A recommending provider must be an MD or DO, in good standing and licensed in Colorado, and registered to submit certifications online. Patients need a new physician certification each time they renew their registration, so the annual visit remains a medical evaluation rather than paperwork. Minor patients must see two physicians and submit two certifications.

Access is the clinic's response to a requirement that recurs every year. MMD accepts walk-in evaluations Monday through Friday from noon to 4 p.m., takes appointments by phone and online, and assists Spanish-speaking patients.
